seller只得迎战。法庭经过取证,开庭,最后判决。seller在listing的时候犯了某些错误,使得卖option这个事情没能做到没有歧义。
所以法官站在老太这一边。老太和老太的经纪都松了一口气。法官问seller,在这块地上只造一个condo要花多少钱。seller回答以前研究过是
18万。自己开发要亏本,才想到另请高明。本来以为来了双枪老太婆。。。。
法官说,责令seller在六个月内把condo造好,然后交给老太。一锤定音。
做地产的都不是随便糊弄的。seller一看这次斗不过老太,马上去请了个律师准备上诉。此律师在本城赫赫有名,或者叫臭名昭著。他大言无耻的广告就是有合同纠纷来找我,因为他认为所有合同都是废纸。
一大笔钱送进去后,律师上诉,取证,开庭。
一开庭,律师对法官说,我跟我的client经过讨论,觉得上次判决绝对没问题,体现了公正正义,司法的严肃性。让任何宵小两股战战,不寒而栗。所以我的
client决定坚决执行上次的判决,在六个月内把condo造好交给plaintiff。但是我们今天要对房子的形式提出异议。
律师拿出原始的REPC。他说你看,这个合同的1.1条上面说
1.1 Included Items. Unless excluded herein, this sale includes the following items if presently owned and in place
on the Property: plumbing, heating, air conditioning fixtures and equipment; ovens, ranges and hoods; cook tops;
dishwashers; ceiling fans; water heaters; light fixtures and bulbs; bathroom fixtures and bathroom mirrors; curtains,
draperies, rods, window blinds and shutters; window and door screens; storm doors and windows; awnings; satellite dishes;
affixed carpets; automatic garage door openers and accompanying transmitters; security system; fencing and any
landscaping.
所以我的client将坚决执行上次的判决和这份原始合同规定的obligation。房子可以造,但不会有任何plumbing, heating,
air conditioning fixtures and equipment; ovens, ranges and hoods; cook
tops;
dishwashers; ceiling fans; water heaters; light fixtures and bulbs; bathroom fixtures and bathroom mirrors; curtains,
draperies, rods, window blinds and shutters; window and door screens; storm doors and windows; awnings; satellite dishes;
affixed carpets; automatic garage door openers and accompanying transmitters; security system; fencing and any
landscaping.
法官看向老太。老太说我撤诉吧。
老太虽然在seller面前败下阵来,但这口恶气还是咽不下去。老太也请了个律师,这回告的是经纪和经纪公司。这次事实很清楚,原来这个事情的起因是老太 误以为这个是卖condo,跟经纪一说,经纪业先入为主认为是卖condo,价格还很划算。但是经纪用的是普通的REPC,而不是new construction REPC。结果经纪公司认栽,给老太造condo。
